TERMS AND CONDITIONS (T&C)
This is for Bestseller Big Brands Fest Sale for Jack & Jones, SELECTED, ONLY & Vero Moda. ("Eligible Products"), which shall take place on the Myntra's mobile app, from 00:00 hrs on 29th December 2022 and end at 23:59 hrs on 30th December 2022. The offer is subject to changes, at the absolute discretion of Myntra and the Brand.

Top two (2) spenders of the Eligible Products during the Offer Period get a chance to win an iPhone 14 (the minimum realized shopping value of Rs. 40,000/- is required to be eligible to win the prize.)
The winners will receive an email to their registered email ID post forty-five (45) days of the offer dates on the actual realized sales post returns.
In case the email ID is not registered on Myntra, we will try to reach the winner over registered phone number only three (3) times.
The Prize will be shipped to the winners post the announcement of winners by the Brand as per the regular lead time.

How to claim the Offer?
Myntra will get in touch with the Winners via their registered mail/phone number as provided on the Platform after forty-five (45) calendar days and confirm the details required and procedures to be followed in order deliver the Prizes.

By participating in this Offer, user ("You", "Your", "Customer" or "Participant") agree to be bound by the following:

OFFER DETAILS
The Offer will commence at 00:00 hrs on 29th December 2022 and end at 23:59 hrs on 30th December 2022. ("Offer Period").
To participate in the Offer You must do/ fulfil the following:
Age must be 18 years or above; and
Must have a valid account on the Platform, log into the same and shop during the Offer Period.
In terms of this Offer, the top spenders ("Winners") with the highest amount of purchase (net of cancellations/refunds/discounts/cashbacks etc.) \from the Eligible Products on the Platform will win for himself/herself the below-mentioned rewards("Prize");
Top two (2) spenders of the Eligible Products during the Offer Period get a chance to win a iPhone 14 with a minimum realized shopping value of Rs. 40,000/-.
The winners will be announced post forty-five (45) days of sale on actual realized value and will be informed on their Myntra registered email ID. The Prize will be distributed to the Winner within thirty (30) days from the announcement of the results through either registered email ID or phone number ("Redemption Period").
You further agree to receive communications from us with regard to your participation in the Offer. Any information collected from You as part of the Offer shall be subject to Myntra's Privacy Policy.
Myntra may use your personal details like Name, email ID & Phone number to announce Winners on the Platform. Details such as contact and address details shall be shared with the Brand for shipping the offer gifts.
7. You acknowledge and confirm that you are aware of the nature of telecommunications/ internet services and that an email transmission may not be received properly and may be read or be known to any unauthorised persons. You agree to assume and bear all the risks involved in respect of such errors and misunderstanding and Myntra or the Brand shall not be responsible in any manner.
8. In the event if any Winner cancels the order for the Products placed during the Offer, he/she shall not be eligible for the Prize.

10. In case the email ID is not registered on Myntra, we will try to reach the winner over registered phone number only three (3) times.
11. In case of a tie, the Winners will be selected on the sole discretion of Myntra.
CUSTOMER INFORMATION AND VISIT TO MOBILE APP
By placing an order for the Offer, you warrant that:

You are legally capable of entering into binding contracts;
You are at least 18 years old, and you are the authorized user of the credit or debit card used to access the Services.
All the Customers shall ensure that the mobile number(s), e-mail address and/or other details provided by them to Myntra via the website/ Myntra mobile app or otherwise are true, accurate and in use, at the time of the online retail transaction. Any liability, consequence or claim arising on account of any incorrect or outdated information provided by the Customers/ Customers to Myntra, shall solely be borne by the affected/concerned Customers/ Customers. Myntra shall not and is not liable to verify the accuracy and/or correctness of the information so provided by the Customers.
Customers are responsible for maintaining the confidentiality of your mobile phones, e-mail accounts and passwords.
Myntra employees and friends / relatives of Myntra employees are not allowed to participate in Offer.
In the event any Winner cancels an order placed for the Eligible Products during the Offer, he/she/they shall not be eligible for the Prize.
OTHER TERMS AND CONDITIONS
Myntra Return & Exchange Policy Offers gives You the option to return or exchange items purchased on Myntra mobile app within thirty (30) days of the receipt. In case of return of the purchased item, please refer to the "Return Policy" on Myntra or write to returns@myntra.com.
The expected delivery duration will be mentioned at the time of booking.
If Myntra has suspicion or knowledge, that any Customer is or has been involved in any fraudulent or illegal activity directly or indirectly during or after the "Offer", Myntra reserves the right to disqualify such Customer and any related Customers.
Myntra and/or Brand shall not be responsible if some purchase is not registered or is lost due to any network issues/problems such as breakdown of machinery, unclear/ disruption in the network or non-receipt of payment from banks/payment gateways and/or the cost(s) charged by the network operator(s). Any dispute in connection to the same shall be settled between the end customer and the network operator without involving Myntra and/or Brand.
Myntra and/or Brand shall not be liable for any loss or damage due to Act of God, Governmental actions, force majeure circumstances, or any other reason beyond its control, and shall not be liable to pay any monetary compensation or otherwise for the same.
Myntra and/or Brand does not hereby warrant that the Myntra Call Center will run concurrently and error free during and/or after the "Offer" and Myntra shall not be directly liable for issues related to technical and/or human error whatsoever. However, Myntra shall work towards the best interest of the Customer.
The Prizes cannot be resold at any point in time.
Customers hereby agree that Myntra and/or Brand has the sole right to decide all matters and disputes arising from this Offer and that all decisions of Myntra and/or Brand are final and binding.
This T&C shall be governed in accordance with the applicable laws in India. Courts at Bangalore shall have the exclusive jurisdiction to settle any dispute that may arise under this T&C.
No other offers will be in conjunction with this Offer.
Myntra shall contact the winners via email or call within seven (7) days of announcing the results.

If and to the extent that Vendor collects, uses, stores, accesses, hosts, records, transfers or otherwise processes (collectively "process" or "processing") any personally identified or identifiable information such as name, age, gender, email address, postal address, telephone number, government identification number, financial information, health information, biometric information, behavioral information or geolocation information, in any form that can be linked to specific individual ("Personal Information") as received by Vendor from or on behalf of Flipkart (or any Flipkart group company) employees, contractors, visitors, customers, clients, partners, sellers, merchants or other third parties or otherwise obtained in connection with the performance of its obligations under this Agreement, Vendor agrees and covenants that Vendor shall treat such Personal Information with the utmost confidentiality at all times, which obligation shall survive in perpetuity. Vendor shall implement appropriate technical and organizational measures to ensure a level of security appropriate to prevent the unauthorized or accidental deletion, accidental loss, or unauthorized disclosure of such Personal Information. Vendor shall process Personal Information solely for the purpose of performing its obligations as contemplated by this Agreement. It is further clarified that the Vendor must not sell, rent, trade, lease, use for its own advertisement or marketing purposes, or otherwise make an unauthorized disclosure of Flipkart's Personal Information to any third party. Vendor shall comply with applicable data protection laws, including but not limited to Information Technology Act, 2000 and the Information Technology (Reasonable Security practices and procedures and sensitive personal data or information) Rules, 2011.

Customer understands that this Offer and other offers are provided by Brands on the Myntra platform and Myntra shall not be liable towards the quality of the Product and/or fulfillment of the Offer and/or warranty claims and/or after sales services of the Product(s) and/or taxes arising out of the same. Any claim or dispute in relation to the same must be directed towards the Brand only.
This Offer is neither created/owned nor sponsored by Myntra. Myntra shall not be responsible if this Offer is in violation with any applicable law. Welcome to Myntra. This page details a limited period Offer (defined below) made available on Myntra mobile application, m-site platform and desktop (shall collectively be referred as �Platform�). Myntra reserves the right to revoke or suspend this Offer at any point of time. 
Please read these terms and conditions carefully before using the Platform (defined below). You should understand that by using the Platform, You agree to be bound by these terms and conditions including �Terms of Use� and �Privacy Policy�. Please understand that if You refuse to accept these terms and conditions, You will not be able to access the Offer provided under the Platform. These terms and conditions are in addition to the Myntra Terms of Use and Your usage of the Platform shall be construed as Your acceptance of these terms and conditions and You shall remain bound by the same.

Referral Program:
Myntra is offering the Participant with a unique link to encourage engagement on the Platform and to gain rewards (�Myncash�). Under this Program, a Participant can share a unique referral link inviting users to the Platform (�Invitee�). In the event Invitee (existing users or new users) invited by the Participant visit the Platform using a unique referral link for the first time during the Offer Period (defined below); both the Participant and the Invitee shall be rewarded Myncash (�Offer�). An �Invitee� under this Offer should be someone who hasn't visited the Platform during the Offer Period (defined below). Myncash to be given to the Participants and Invitee will be ranging from 50-150 as a surprise offer with the addition of a scratch card layer. This Offer is available from midnight on 9th Dec, 2022 till 23:59 hours of the last day of EORS (�Offer Period�). Other terms:

Myntra retains the right to share any and all data received from the Participant or Invitee under this Offer or anywhere captured on the Platform, with third parties for the sake of analysis and the Participant/ Invitee explicitly consents to the same.

A Participant/ Invitee can combine this Offer with other discounts available on the Platform during the Offer Period.

This Offer shall be subject to force majeure events and on occurrence of such an event, the Offer may be withdrawn at the discretion of Myntra with no prior intimation to the Participant/Invitees. The decision of Myntra in this regard shall be final and binding on the Participant and/or Invitee.

A Participant and a Invitee do not have to purchase on the Platform for Myncash to be reflected on their profile accounts.

Myntra reserves the right, in its sole discretion, to disqualify any Participant or Invitee that tampers or attempts to violate the Offer. The decision of Myntra in this regard shall be final and binding on the Participant or Invitee.

Participant or Invitee can only utilize Myncash to pay 10% of the transaction value on each order.

Myntra shall not be responsible towards any losses, including but not limited to any damages, claims costs, injury or any other liability in any form arising due to the participation by a Participant/ Invitee in the Offer.
